1) Acceptance of Terms
By accessing or using the Site, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Site.
2) Changes to These Terms
I may update these Terms at any time by posting a revised version on the Site. Your continued use after changes become effective constitutes acceptance.
3) Site Purpose; No Professional Advice
The Site covers security-related topics, commentary, and news. All content is provided “AS IS” and “AS AVAILABLE,” on a best-effort, informational basis only. It is not legal, security, financial, or professional advice. You are solely responsible for how you use any information here.
4) Automated Access (Allowlisted Crawlers Only)
Automated access or scraping is permitted only for the following “Approved Crawlers”:
Google (Googlebot family), Microsoft (bingbot), DuckDuckGo (DuckDuckBot), Apple (Applebot), Archive.org(ia_archiver), OpenAI (GPTBot), Anthropic (ClaudeBot), and xAI (Grok), plus standard link-preview fetchers (Twitterbot, facebookexternalhit/facebot, LinkedInBot, Slackbot, Discordbot, TelegramBot).
Approved Crawlers must: (i) present their authentic User-Agent; (ii) originate from verifiable reverse-DNS for the operator and/or published IP ranges; (iii) follow robots.txt; and (iv) avoid degrading service (no hammering/DoS/exploit attempts).
All other automated access is prohibited without my prior written consent. I may implement technical or legal measures to restrict access, including per-bot kill switches; attempts to misrepresent identity, spoof a User-Agent, or circumvent controls are prohibited.
5) General Acceptable Use
You agree not to: (a) probe, scan, or test the vulnerability of the Site or related systems without prior written authorization; (b) bypass or interfere with security or access controls; (c) introduce malware or attempt denial-of-service; (d) harvest legally protected personal data or use the Site to facilitate doxxing, harassment, or illegal activity; or (e) violate any applicable laws or regulations.
6) Access Controls: IP/User-Agent/Region Bans
I may, at my sole discretion and without notice, restrict or terminate access by blocking or filtering IPs, user-agents, ASNs, regions, or devices, applying rate limits, and using other technical measures. Attempts to circumvent such controls are prohibited.
7) Cooperation with Investigations; Log Preservation
I may collect and retain standard access/security logs (e.g., IP address, user-agent, timestamps, request paths) to operate and protect the Site. I will cooperate with investigations and lawful requests from local, state, and federal authorities, courts, or regulators. I may preserve or disclose logs and related information when I, in good faith, believe it is reasonably necessary to comply with law, enforce these Terms, or protect rights, property, or safety.
8) User Content (Comments, If Enabled)
If you submit content (e.g., comments), you grant me a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute it in connection with operating the Site. You represent you have all necessary rights and that your content complies with law and these Terms. I may remove content at my discretion.
9) Intellectual Property; Fair Use
Except for your own content, the Site’s content and code are protected by U.S. and international laws. You may quote brief excerpts with attribution and a link back to the source URL. Wholesale republication or mirroring of full posts requires permission unless otherwise permitted by fair use or applicable law.
10) Third-Party Links & Embeds
The Site may link to or embed third-party content. I am not responsible for third-party sites, policies, or practices.
11) Privacy; State-Law Rights
Your use of the Site is subject to my Privacy Policy. I will honor applicable U.S. state privacy laws (e.g., CA, CO, CT, UT, VA, OR, and others as they come online) as described there, including rights to access, deletion, correction, and opt-out where applicable.
12) Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, I DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. I DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT IS ACCURATE, COMPLETE, OR CURRENT.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, I WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, EVEN IF ADVISED OF THE POSSIBILITY. MY TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID ME (IF ANY) DURING THE THREE MONTHS BEFORE THE CLAIM AROSE.
14) Indemnification
You agree to indemnify and hold me harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your content, or your violation of these Terms or applicable law.
15) Export Controls & Sanctions
You represent you are not subject to U.S. sanctions and will not use the Site in violation of U.S. export control or sanctions laws.
16) Dispute Resolution — Binding Arbitration; Class-Action Waiver; 30-Day Opt-Out
(a) Agreement to Arbitrate. You and I agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by final and binding arbitration under the Federal Arbitration Act (FAA), rather than in court, except that either party may bring an individual action in small-claims court in Jackson County, Oregon (or your U.S. county of residence if small-claims rules allow).
(b) Rules and Forum. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules (or, if JAMS is unavailable, the AAA Consumer Arbitration Rules). The arbitrator will be a licensed attorney or retired judge. If an in-person hearing is required, it will occur in Jackson County, Oregon, or by video at the arbitrator’s discretion.
(c) Fees. JAMS/AAA rules govern fee allocation. If the arbitrator finds your claim non-frivolous, I will pay your share of arbitration filing and hearing fees beyond what you would pay to file in court.
(d) Individual-Only; Class-Action Waiver. Arbitration is only on an individual basis. No class, collective, consolidated, or representative proceedings. The arbitrator may award relief only to the individual party seeking relief and only as necessary to provide relief warranted by that party’s claim.
(e) 30-Day Right to Opt Out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of your first use of the Site after this clause takes effect, stating your full name and that you wish to opt out of arbitration.
(f) Injunctive Relief. Notwithstanding the above, either party may seek temporary or preliminary injunctive relief in state or federal court in Jackson County, Oregon to protect intellectual property or Site security pending arbitration.
(g) Severability. If the class-action waiver in 16(d) is found unenforceable as to a particular claim, then that claim must proceed in court—not arbitration. If any other provision of this Section 16 is found unenforceable, the remaining provisions still apply.
17) Governing Law and Venue
These Terms are governed by the laws of the State of Oregon, without regard to conflicts rules. Subject to Section 16, you agree to the exclusive jurisdiction and venue of the state or federal courts located in Jackson County, Oregon.
18) Termination
I may suspend or terminate access to the Site at any time, with or without notice, including for suspected violations of these Terms. Sections 3–17 and 19 survive termination.
19) Miscellaneous
If any provision is found unenforceable, it will be enforced to the maximum extent permitted, and the remainder will remain in effect. These Terms are the entire agreement between you and me regarding the Site and do not create any partnership, employment, or agency relationship.
